Nike Sues Adidas

Nike filed a lawsuit against Adidas alleging patent infringement of its SHOX cushion technology in federal court in Texas on Thursday.

NEW YORK — Nike filed a lawsuit against Adidas alleging patent infringement of its SHOX cushion technology in federal court in Texas on Thursday.

The lawsuit alleged that a number of Adidas’ shoes, including its Kevin Garnett line, Adidas Cushion shoe, Adidas_1 and Adidas Adistar Cush M shoe, willfully infringes on Nike’s patent for its SHOX system. According to the court documents, Nike asked that Adidas be enjoined from further infringement, for treble damages, prejudgment interest and for attorney’s fees and costs associated with the lawsuit.

“Nike is widely recognized for its product innovation in footwear and athletic products and we invest heavily to provide performance products to our consumers. It is deeply frustrating and inappropriate when companies borrow or refashion such technologies as their own without making similar investments,” said Eric Sprunk, vice president, global footwear, Nike, in a statement released by the company.

Nike recently filed two unrelated patent lawsuits against Air Max Import and Export Inc. and Romeo and Juliette. Adidas did not return requests for comment.
