NEW YORK — A federal judge has given the green light for a trial on The Warnaco Group’s breach-of-contract lawsuit against VF Corp. over the Warner’s label in Spain and Portugal.
Judge Robert W. Sweet has denied VF’s bid to throw out the case, filed last July in federal court here.
Warnaco is seeking more than $30 million in damages, claiming VF and its Spanish subsidiary, Vives Vidal SA, conspired to destroy the Warner’s brand in that market to pump up sales of its own intimate apparel brands.
The suit also seeks punitive of not less than $15 million .
VF acquired Vives Vidal, known as Vivesa, in 1992. Vivesa had been a licensee for the Warner’s brand.
A VF spokeswoman declined comment.
