The legal tussle between Allergan Inc. and Jan Marini Skin Research over eyelash enhancement has ended. Allergan has reached an undisclosed settlement with Jan Marini, one of several defendants in a lawsuit filed in November. The lawsuit targeted companies alleged to market products with prostaglandin analogues — compounds used to amplify lashes — patented by the Botox maker. “We are pleased that Jan Marini…has agreed to cease further distribution of its eyelash growth products,” stated Douglas S. Ingram, Allergan’s executive vice president, chief administrative officer, general counsel and secretary. The original lawsuit that included Jan Marini is ongoing with a trial date set for next year, according to Allergan. RevitaLash producer Athena Cosmetics; Intuit Beauty Inc., the manufacturer of MassiveLash, and PhotoMedex Inc., which sells MD Lash Factor, are among the remaining defendants.
