The legal battle between Perry Ellis International Inc. and Victory International (USA) LLC over the Perry Ellis fragrance license has ended. According to documents filed July 30 in U.S. District Court for Southern Florida in Miami, Victory International has accepted a $30,000 settlement from Perry Ellis International. In August 2006, Victory International had signed a letter of intent to buy the license for $140 million from Parlux Fragrances Inc. That October, however, Perry Ellis International informed Parlux Fragrances that it did not consent to the deal and acquired the license for $63 million in cash later in the year. In January 2007, Victory International filed a complaint accusing Perry Ellis International of fraud and interference with contract. It sought an award of damages of “not less than an aggregate amount exceeding $250 million.” According to the settlement, Perry Ellis International will award Victory $10,000 while company founder and chief executive officer George Feldenkreis and chief operating officer Oscar Feldenkreis will each give $10,000. Both companies declined to comment on the settlement.
Rolex Watch USA Inc. has obtained a permanent injunction against a New York landlord and his tenants at two buildings on Canal Street in Manhattan. According to court documents filed July 21 in U.S. District Court in Manhattan, defendant Michael Marvisi, who owns 365 Canal Street Corp. and 326 Canal Street Corp., consented to the order. The injunction bans any tenants from making or distributing counterfeit Rolex goods. Rolex filed suit against Marvisi in March 2004. A call to Marvisi’s attorney seeking comment was not returned.
