NEW YORK -- Jewelry designer Paloma Picasso is suing Anne Klein & Co., Swank Inc. and Federated Department Stores for allegedly stealing a kiss.
According to a complaint filed in federal court here, Picasso says Swank, at Anne Klein's request, made earrings that infringed on her copyrighted and trademarked "Kiss" design, featuring a stylized X, and the jewelry was sold through Federated's Bloomingdale's division.
Picasso, who says damages could top $500,000, notes she will seek "in excess of $1 million" in compensatory and punitive damages if the defendants continue to sell copies of her design. Besides the monetary claims, she is seeking a preliminary and permanent injunction against the defendants' selling the infringing merchandise, and for the destruction of those items.
Swank and Anne Klein officials said they were not familiar with the suit and could not comment. A spokeswoman at Federated said the company does not comment on lawsuits.
