Malibu Textiles Inc. filed a copyright infringement lawsuit against women’s apparel retailer Bebe Stores Inc. In court documents filed in the U.S. District Court for the Southern District of New York on March 19, Malibu alleged Bebe copied lace designs that were owned and registered by Malibu for use in its All Over Lace Tee. Malibu is seeking either the amount of all its “actual damages and Bebe’s profits, gains or advantages of any kind resulting from the infringement,” or statutory damages of up to $150,000 per infringing work, as well as the destruction of all products found to be infringing and court costs. Bebe did not return a call for comment.
