Taubman Centers’ long-delayed Mall at Oyster Bay in Oyster Bay, N.Y., may finally become a reality.

A ruling in the long and bitter battle between Taubman and the Town of Oyster Bay, N.Y., has cleared the way for the project to move forward. New York State Supreme Court Justice Jeffrey Spinner ordered that the town issue a special use permit to the Bloomfield Hills, Mich., developer.

Taubman has proposed a 750,000-square-foot luxury shopping center for the site, a former Cerro Wire and Cable Company factory, with anchors Neiman Marcus, Nordstrom and Barney’s New York.

The Mall at Oyster Bay will be the first new major retail property built in Long Island in more than 30 years. When Taubman initially proposed a 1 million-square-foot shopping center on the site 13 years ago, there was immediate opposition from the community. The Cerro Wire Coalition, a group of 32 civic and business groups, has objected to the mall, citing concerns about traffic, overdevelopment and road safety.

The coalition is said to be partially funded by Simon Property Group of Indianapolis, a Taubman competitor and owner of the Roosevelt Field mall in Garden City, N.Y.
