Seven For All Mankind has been awarded a permanent injunction and consent judgment against a company it accused of using unauthorized trademarks on its jeans.
The premium denim manufacturer filed suit against New York-based Regine Ltd. and two named defendants, Behzad and Robert Berookhin, on Sept. 13. In the complaint, Seven alleged violations on eight counts, including trademark counterfeiting, false designation of origin and false advertising.
A settlement agreement was reached on Dec. 23, followed by the filing of a consent judgment on Dec. 28 that permanently barred the defendants from designing, advertising or attempting to sell infringing jeans. Monetary terms of the settlement were not disclosed. However, each party will bear the cost of its own attorney’s fees and costs, according to court documents.
“Our company takes counterfeiting very seriously and is willing to commence actions like this one against sellers of fakes,” said Barbara Kolsun, senior vice president and general counsel of Seven For All Mankind. “Counterfeiting is not only a crime, but an actionable civil wrong.”
Regine declined to comment.
