PEACE REIGNS: Despite reports to the contrary, there are no new legal spats between Tim Schifter‘s firm, Schifter & Partners, and Brand Science, an affiliate of Accessory Network that does business as LeSportsac. In court proceedings last month, both parties agreed to abide by the terms of a nonsolicitation agreement signed when Schifter left the company he once owned to start his own firm, and that agreement remains in place. Brand Science filed a breach of contract lawsuit against Schifter and his firm on May 4. During a hearing before State Supreme Court Justice Herman Cahn on May 10, Schifter consented to continue to abide by the terms of an agreement that prohibits him from soliciting customers of LeSportsac for a period of time ending in August. At the hearing, Judge Cahn ordered Brand Science to continue to pay Schifter money owed to him as part of the original agreement, and Brand Science withdrew its request for a preliminary injunction that was part of the initial lawsuit against Schifter. Costs still have to be determined in the case, however.
