SYMS/FILENE’S BASEMENT EXAMINER REQUEST: The Syms Corp./Filene’s Basement estate is requesting from a Delaware bankruptcy court the appointment of an examiner to investigate possible claims against the bankrupt company’s directors and officers for “breach of fiduciary duty, mismanagement, waste and any similar claims,” according to court documents. The document also said the investigation should cover the time period from June 2009, when Syms acquired the assets of subsidiary Filene’s Basement, to the date it filed its voluntary petition on Nov. 2. Court papers also said it filed its motion due to state court litigation alleging prepetition mismanagement of Syms. That litigation is in a New Jersey state court and was filed by Esopus Creek, an equity shareholder. A hearing on the request is scheduled for later this month.
