PARIS (HILTON) SUES: Paris Hilton and Parlux Fragrances LLC slapped competitor International Perfume Palace Inc. with a lawsuit, which claims its packaging for its perfume and body wash products are “identical or confusingly similar” to the heiresses’ products.
Filed in New York Eastern District court last week, Hilton and Parlux allege that Perfume Palace has created a “Paris Paris” collection of products that infringes on its trademark, trade dress and design patent.
In 33-page lawsuit, which includes side-by-side photos of box sets of Hilton’s product next to IPP’s Paris Paris line, Parlux said it got wind of the infringement while at a trade show in Las Vegas this summer. Parlux had procured some samples from IPP’s booth, which it alleges would “deceive” an “ordinary observer” into thinking that the Paris Paris design was the same as its design. Hilton and Parlux are looking for maximum damages, attorneys’ fees and other costs.
